Unlike many civil cases which conclude upon the rendering of a Final Judgment, Final Judgments in family law cases often require the parties to return to Court years later to enforce court orders against noncompliant parties or to modify child support, child custody, relocation restrictions and/or alimony when there has been a change in circumstances of one or both of the parties or the children. Although a divorce, paternity action or modification proceeding can be an emotional process, the majority of cases do not result in a trial. The Court will require the parties to attend mediate prior to trial in an effort to resolve the issues amongst themselves. If the issues are resolved a trial is not required. In order to file for divorce in Florida there is requirement of residency for at least one of the parties to reside in Florida for a period of 6 months preceding the filing date. The venue, or county, where the case should be filed is in the county where the parties last lived as husband and wife.
